Thank you for visiting the official website of MadamEsoteric.com (the "Site"). Here is our policy to help ensure the privacy of your personally identifiable information. It describes how the Site uses and share your personal information when you visit or make a purchase from us. By using this Site, you accept all the practices described in this Privacy Policy.

Since personal data of users and customers of this Site (collectively “Users”) may be processed in Portugal, any such processing of personal data will be conducted in compliance with the Portuguese Data Protection Regulation.

If you have any questions about this privacy statement or the content and practices of our Site, please feel free to contact us directly at support@madamesoteric.com.

SECTION 1 - PERSONAL INFORMATION

When you visit www.madamesoteric.com, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to our website, and information about how you interact with us. We refer to this automatically-collected information as “Device Information”.

We collect Device Information using the following technologies:

  •  “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.
  •  “Log files” track actions occurring on www.madamesoteric.com, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.
  •  “Web beacons”, “tags”, and “pixels” are electronic files used to record information about how you browse the website.

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, paypal, stripe, mbway), email address, and phone number. We refer to this information as “Order Information”.

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information. When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no. If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, by contacting us at support@madamesoteric.com.

SECTION 2 - USING PERSONAL INFORMATION

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

  •  Communicate with you;
  •  Screen our orders for potential risk or fraud; and
  •  When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

SECTION 3 - SHARING PERSONAL INFORMATION

We provide information to trusted third parties service providers in order to perform services, such as processing credit cards, checks, orders, returns, refunds and credits, transmitting emails from us to you and managing customer information.

For example, Shopify Inc provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. Shopify Inc store your data on a secure server behind a firewall.

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

You may also read more about Shopify’s Terms of Service (https://www.shopify.com/legal/terms) or Privacy Statement (https://www.shopify.com/legal/privacy).

We also use Google Analytics to help us understand how our customers use the Site (you can read more about how Google uses your Personal Information here: https://www.google.com/intl/en/policies/privacy/). You can also opt-out of Google Analytics here: https://tools.google.com/dlpage/gaoptout).

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

SECTION 4 - THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

By using our website, you agree to allow third parties to process your IP address, in order to determine your location for the purpose of currency conversion. You also agree to have that currency stored in a session cookie in your browser (a temporary cookie which gets automatically removed when you close your browser). We do this in order for the selected currency to remain selected and consistent when browsing our website so that the prices can convert to your local currency.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

Finally, when you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

SECTION 6 - SECURITY

To protect your personal information, we take precaution and follow industry best practices to ensure that it is not lost, corrupted, disclosed, changed or destroyed. If you provide us with your credit card information, that information is encrypted using technology (SSL) and recorded with the encryption protocol AES-256. However, no method of Internet transmission or electronic storage is 100% secure, but we will follow all the PCI-DSS procedures.
